We want you to be satisfied with your purchase. This policy outlines your right to cancel, how to return products, and what to do if goods are damaged or not as described, in line with applicable **EU and Lithuanian consumer protection laws**.

Right to Cancel – Important Notice for Food Products
Under EU and Lithuanian consumer protection law, consumers generally have a 14‑day right to withdraw from an online purchase without giving a reason.
However, this right does not apply to most food products.
No General Right to Cancel for Food Products
Because our products are food and beverages, including fermented drinks, the 14‑day cancellation (change‑of‑mind) right does not apply, in accordance with applicable food safety and consumer protection regulations.
This means that once a food product has been delivered, you cannot cancel the purchase or request a refund simply because you have changed your mind.
Legal Exceptions to the Right to Cancel
The right to cancel does NOT apply to:

Perishable goods
Goods that may deteriorate or expire rapidly. This applies to many food products and may apply to our fermented drinks depending on their nature and storage requirements.

Sealed food and drink products
Products sealed for health protection or hygiene reasons, once the seal has been broken after delivery.

Products inseparably mixed after delivery
Any products that become mixed with other items in such a way that they cannot be separated after delivery.

Faulty or Non‑Conforming Food Products
This limitation does not affect your statutory rights if a product is:

unsafe,
-
spoiled,
-
damaged,
-
expired,
-
incorrectly supplied, or
-
otherwise not in conformity with the contract.
In such cases, you may be entitled to a replacement or refund in accordance with food safety, consumer protection, and civil law requirements.-

To exercise the right to cancel, you must inform us of your decision by a clear statement before the cancellation period has expired.

You can do this by emailing us at sales@nordic-berry.com or by sending a letter to our registered address. Please include your name, address, order number, details of the product(s) you wish to return, and the reason for the return.

You may use the model cancellation form at the end of this policy if you wish, but it is not obligatory.

We will contact you as soon as possible after receiving your cancellation request to acknowledge it and provide instructions for returning the product(s).

Because food products are perishable, you must notify us as soon as reasonably possible after delivery (preferably within 24–72 hours of receipt).
When contacting us, please provide:-
your order number,

a description of the issue, and

clear photographic evidence where possible.

Timely reporting is essential to allow proper verification and food safety assessment.-

If you cancel your contract because you have changed your mind, we will reimburse to you all payments received from you for the returned goods, including the costs of standard delivery (we will not refund supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).

We may make a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result of unnecessary handling by you beyond what is necessary to establish the nature, characteristics, and functioning of the goods (e.g., if the product is not returned in a resalable condition as outlined in section 3).

We will make the reimbursement without undue delay, and not later than:

14 days after the day we receive back from you any goods supplied, or

(if earlier) 14 days after the day you provide evidence that you have returned the goods, or
-
if there were no goods supplied (e.g., for a service), 14 days after the day on which we are informed about your decision to cancel this contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

After receiving the returned product and confirming it meets the return conditions, we will process your refund. Please allow up to 5-10 working days for the funds to appear in your account, depending on your bank or card issuer.

We are legally obliged to supply food products that conform to the contract, in accordance with EU food safety legislation, Directive (EU) 2019/771, and the Civil Code of the Republic of Lithuania. This means food products must:

match their description,
-
be safe for consumption,

meet applicable quality standards, and
-
comply with stated shelf‑life, storage, and ingredient information.

Problems With Food Products
If you receive a food product that is:

unsafe,
-
spoiled,
-
damaged on arrival,
-
past its expiry or “best before” date, or
-
otherwise not as described,
please contact us as soon as reasonably possible after delivery (preferably within 48 hours) at [insert contact email], providing:

photographic evidence where possible.
Timely notification is critical for food safety assessment.
Your Legal Rights for Food Products
Because food products are perishable and intended for consumption, the following applies:

Right to conformity
Food products must conform to the contract and be fit for consumption at the time of delivery.

Remedies
If a food product is confirmed to be non‑conforming, you are entitled to:-
a replacement, or

a refund, depending on the circumstances.
Repair is not applicable for food products.

Limitations
Refunds or replacements will not be provided if:-
the product was damaged due to improper storage or handling after delivery,

the issue arises after the product has been consumed,
-
the complaint is made unreasonably late, making verification impossible.

Presumption of defect
For food products, conformity is assessed at the time of delivery. Due to their perishable nature, the general 12‑month presumption applicable to durable goods may not apply in practice.
Return of Food Products
For food safety and hygiene reasons, food products must not be returned unless explicitly requested by us. If a return is required and the product is confirmed to be faulty or non‑conforming, we will cover the reasonable cost of return or disposal, as applicable.
This Policy and Your Rights
This policy is provided in accordance with EU and Lithuanian consumer protection law and does not limit or exclude your statutory rights.

If you fail to collect the goods from the courier or delivery point within the timeframe specified by them, or if the goods cannot be delivered due to your fault or unavailability, the goods may be returned to us.

In such cases, the order may be cancelled. You will be refunded the amount paid for the goods, less any applicable bank charges incurred by us for payment processing, less the original delivery charge, and less any direct costs incurred by us for the return of the goods. We will contact you to inform you of this.
